Terms and Conditions of Sale

1. Website owner and scope

The edhenmilano.com website and its online store are operated by LUXCOMM S.r.l., with registered office at Via Fatebenefratelli 5, 20121 Milan (MI), Italy, VAT No. 09313230964 (“Edhèn Milano” or the “Seller”). For order-related enquiries, please email contact@edhenmilano.com.

These Terms and Conditions govern purchases made through the website. Customers should read them carefully before placing an order. Nothing in these Terms limits any mandatory consumer rights available under applicable law.

2. Products and availability

Product images and descriptions are provided as accurately as possible. Minor differences in colour, finish or proportion caused by screen display, craftsmanship or the natural characteristics of materials do not constitute defects.

Availability shown on the website may change. If an ordered product becomes unavailable, the Customer will be informed promptly and any amount already paid for that product will be refunded.

3. Orders and formation of the contract

Submitting an order constitutes an offer to purchase. The Customer will receive an automatic acknowledgement after placing the order. The contract is concluded when Edhèn Milano sends the order confirmation or shipping confirmation, unless expressly stated otherwise.

Edhèn Milano may refuse or cancel an order for legitimate reasons, including product unavailability, an obvious pricing or description error, inability to authorise payment, or suspected fraud. Any amount already collected will be refunded.

4. Prices, taxes and payments

Prices are displayed in the currency selected on the website and include VAT where applicable. Shipping charges, taxes and any other applicable costs are shown before the order is confirmed.

The payment methods available are those displayed at checkout. The Customer confirms that they are authorised to use the selected payment method. Edhèn Milano does not directly store complete payment-card details.

5. Invoicing

The Customer is responsible for providing accurate billing information. Any invoice request must be made using the options available during checkout or by promptly emailing contact@edhenmilano.com.

6. Shipping, delivery, risk and duties

Available delivery methods, charges and estimated timeframes are shown at checkout. Unless otherwise agreed, delivery will take place without undue delay and no later than 30 days after the contract is concluded.

For consumers, the risk of loss or damage passes when the Customer, or a third party appointed by the Customer other than the carrier, takes physical possession of the products.

For deliveries outside the European Union, any customs duties, import taxes and charges imposed in the destination country are payable by the recipient unless otherwise stated at checkout.

7. Right of withdrawal

Consumers have the right to withdraw from a purchase without giving any reason within 14 days from the day on which they take physical possession of the products. Where multiple products from one order are delivered separately, the period begins upon delivery of the final product.

To exercise the right of withdrawal, the consumer must send an unequivocal statement before the deadline to contact@edhenmilano.com. It is sufficient for the notice to be sent before the withdrawal period expires.

8. Returns and refunds

After giving notice of withdrawal, the consumer must return the products without undue delay and no later than 14 days thereafter. Direct return costs are borne by the Customer unless the product is defective, incorrect, or otherwise agreed.

Products should be returned complete and undamaged, with their accessories and original packaging where reasonably possible. The consumer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

Edhèn Milano will refund all payments received for the returned products, including the original standard delivery charge. Any additional cost resulting from the Customer’s choice of a delivery method other than the least expensive standard method offered will not be refunded. The refund will be made within 14 days of receiving the withdrawal notice, using the same payment method used for the purchase unless otherwise agreed. The refund may be withheld until the products are received or the consumer provides evidence of return, whichever occurs first.

9. Legal guarantee of conformity

Products sold to consumers are covered by the statutory guarantee of conformity required by applicable consumer law. If a lack of conformity existed at delivery and becomes apparent within the statutory period, the consumer may exercise the available remedies, including repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract. 10. Personalised, made-to-measure and pre-order products

The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised, where the statutory exception applies. Any such exclusion will be clearly disclosed before purchase.

Designation as a “pre-order” does not, by itself, remove the right of withdrawal. Availability dates or periods for pre-orders are estimates and may change; the Customer will be informed of any material delay.

11. Privacy and marketing communications

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), Italian Legislative Decree No. 196/2003 as amended, and other applicable law. For more information, please see the Privacy Policy.

Marketing communications and newsletters are sent only where there is a valid legal basis, including consent when required. Consent may be withdrawn and subscriptions cancelled at any time using the link included in each communication.

12. Intellectual property

Trademarks, images, text, graphics, photographs, videos and all other website content are protected by applicable law and may not be used, reproduced or distributed without prior authorisation, except where permitted by law.

13. Force majeure

Edhèn Milano is not liable for delays or failures caused by events beyond its reasonable control. Mandatory consumer rights remain unaffected.

14. Governing law and jurisdiction

These Terms are governed by Italian law. If the Customer is a consumer resident in another country, any mandatory protections under the law of their country of residence remain applicable. Consumer disputes will be heard by the courts having jurisdiction under mandatory consumer law, including the courts of the consumer’s place of residence or domicile where applicable.
